I understand that on-site family mediation is further intended to provide the opportunity for efficient resolution of issues referred by judges and lawyers or requested by parties on a daily court list appearing for a court attendance. \r\n<br \/>\r\n\r\n1.5.\tI understand the process of family mediation is voluntary.\r\n<br \/>\r\n\r\n1.6.\tI understand that the Mediator is not a judge, arbitrator, or assessor and does not represent or act on behalf of the Parties. I understand that the Mediator is an impartial facilitator whose role is to help us communicate and negotiate in an attempt to voluntarily resolve our issues on consent. \r\n<br \/>\r\n\r\n1.7.   \tI understand that the responsibility for resolving our issues rests with us, not the Mediator.\r\n<br \/>\r\n\r\n1.8.    I understand that we may participate in mediation at a distance and that technology will be used in distance mediation. I also understand that while we may participate in mediation in different locations from each other, it does not preclude one or more of us from being present with the Mediator for the purposes of the mediation.\r\n<br \/>\r\n<br \/>\r\n<h3> 2.\tISSUES TO BE MEDIATED<\/h3>\r\n<br \/>\r\n2.1.\tI agree to work with the Mediator to try to resolve those issues we identify, which can include:\r\n<div style=\"margin-left: 50px; margin-top: 15px\">\r\n<ul>\r\n<li>decision-making responsibility for the child(ren);<\/li>\r\n<li>care and parenting time with the child(ren);<\/li>\r\n<li>relocation, travel with the child(ren);<\/li>\r\n<li>child support;<\/li>\r\n<li>spousal support; or<\/li>\r\n<li>possession, ownership, equalization and division of property.<\/li>\r\n<\/ul><ul>\r\n<\/ul><\/div>\r\n\r\n<h3>3.\tINDEPENDENT LEGAL ADVICE & LEGAL REPRESENTATION<\/h3><br \/>\r\n3.1.\tI understand that the Mediator will not offer legal advice to any of us, and that the Mediator has no duty to assert or protect our legal rights.<br \/>\r\n3.2.\tI understand that it is in my best interest to seek independent legal advice before, throughout, and after the mediation process.<br \/>\r\n3.3.\tI acknowledge that I have been advised to seek independent legal advice, if I have not already done so. I understand that this legal advice will help me to better appreciate our respective rights and obligations in resolving our issues, and to better understand whether any agreement we make is reasonable and fair. <br \/>\r\n\r\n3.4.   When issues are resolved, the Mediator will prepare a written report for us. I acknowledge that the Mediator\u2019s report is not a final or legally binding agreement, nor is it evidence of an agreement. I agree that I will not rely on the Mediator\u2019s report in a legal proceeding, nor will I use it as evidence of any settlement.<br \/>\r\n\r\n3.5.\tI understand that if we wish to make the Mediator\u2019s report into a legally binding agreement, that either party may enforce, it is in each of our best interest to seek an independent lawyer\u2019s advice and assistance for that purpose.<br \/>\r\n\r\n3.6. When issues are resolved, the Mediator will prepare a written report for us. I acknowledge that the Mediator\u2019s report is not a final or legally binding agreement.\r\n<br \/>\r\n\r\n3.7.\tI understand that if we wish to make the Mediator\u2019s report into a legally binding agreement, it is in each of our best interest to seek an independent lawyer\u2019s advice and assistance for that purpose.\r\n<br \/>\r\n<br \/>\r\n<h3>4.\tTYPE OF MEDIATION<\/h3><br \/>\r\n4.1.    The Mediator has fully explained to me the difference between open and closed mediation. I understand that our on-site family mediation process will be closed mediation. I understand that in closed mediation, the Mediator\u2019s report will summarize only those issues resolved.\r\n<br \/>\r\n<br \/>\r\n<h3>5.\tMEDIATION SESSIONS<\/h3><br \/>\r\n5.1.\tI feel we can negotiate with each other and freely discuss our issues in an equal, open, honest, and constructive manner. However, if any of us feels intimidated in any way during the mediation process, we will immediately advise the Mediator and may do so privately.\r\n<br \/>\r\n5.2.\tI acknowledge that, generally, the Mediator will meet with the Parties in joint sessions. However, occasionally the Mediator may wish to meet with one Party individually.\r\n<br \/>\r\n5.3.\tI am aware that the Mediator may also wish to meet with the child(ren), or any other significant third parties such as a new partner, grandparents, other relatives, lawyers, and legal representatives. However, the Mediator must obtain our consent before involving another person in the mediation process. \r\n<br \/>\r\n5.4.    I also understand that if any Party wishes to have another person in the room, the Party must obtain the permission of the Mediator and other Party(ies) prior to the mediation session beginning. \r\n<br \/>\r\n5.5.   Where all Parties agree that another person will be privy to the mediation process, that person must also sign this agreement to mediate and is bound by the terms of the mediation.\r\n<br \/>\r\n<br \/>\r\n<h3>6.\tMEDIATION AT A DISTANCE<\/h3><br \/>\r\n6.1.\tWhere mediation includes distance mediation, the Mediator will conduct the mediation using Microsoft Team or Zoom technology or any other technology suitable to the Party(ies) participating in the distance mediation. \r\n<br \/>\r\n6.2.\tBy signing this Agreement to Mediate, the Party(ies) who will participate in distance mediation, accept and agree to the terms and guidelines associated with distance mediation and the use of technology identified in this agreement.\r\n<br \/>\r\n<br \/>\r\n<h3>7.\tCONFIDENTIALITY<\/h3><br \/>\r\n7.1.\tThe Mediator and the Parties shall keep confidential all written and verbal information prepared, provided, disclosed, or exchanged during or for the purpose of the mediation. \r\n<br \/>\r\n7.2.\tNotwithstanding the aforementioned, the Mediator may, at their sole discretion, disclose information about the mediation:\r\n<br \/>\r\n<div style=\"margin-left: 50px\">\r\n(a) The Mediator, Mediation Service Provider, intern, or observer to testify or otherwise participate in any legal proceeding, including but not limited to any court or arbitration hearing;\r\nor<br \/>\r\n(b) Where ordered to do so by law;<br \/>\r\n(c) Where required to do so by law, including but not limited to obligations to report a child in need of protection; or <br \/>\r\n (d) Where the information indicates an actual or potential threat to human life or safety.<br \/>\r\n<\/div>\r\n<br \/>\r\n7.3.\tI acknowledge that our discussions in mediation are only for the purpose of reaching an agreement regarding the issues between us. I agree not to summons or compel:\r\n\r\n<div style=\"margin-left: 50px\"><br \/>\r\n(a) The Mediator, The Family Mediation Centre, intern, or observer to testify or otherwise participate in any legal proceeding, including but not limited to any court or arbitration hearing; or<br \/>\r\n(b) The disclosure of any mediation documents, including the Mediator\u2019s report. However, documents that are otherwise discoverable or admissible as evidence in a legal proceeding do not become inadmissible or non-discoverable merely because of their use during the mediation process.\r\n<\/div>\r\n<br \/>\r\n<h3>8.\tDISCLOSURE OF INFORMATION BY THE MEDIATOR<\/h3><br \/>\r\n8.1\tI understand that the Mediator will not voluntarily disclose to anyone who is not a party of the mediation, any verbal or written communication that has taken place during the mediation process. The only exceptions include disclosure of information:<br \/>\r\n<div style=\"margin-left: 50px\">\t<br \/>\r\n(a)\tTo the Parties\u2019 lawyers or legal representatives;<br \/>\r\n(b)\tWhere ordered to do so by law;<br \/>\r\n(c)\tWhere required to do so by law (including, but not limited to, information about a potential child protection issue);<br \/>\r\n(d)\tWhere information suggests an actual or potential threat to human life or safety;<br \/>\r\n(e)\tFor research, education, or program reporting or evaluation purposes (non-identifying information);<br \/>\r\n(f) On the written consent of all Parties; or <br \/>\r\n(g)\tWhere any Party makes a claim against the Mediator, Mediation Service Provider, or intern or observer.\r\n<\/div><br \/>\r\n\r\n<h3>9.\tDISCLOSURE OF INFORMATION BY THE PARTIES<\/h3><br \/>\r\n9.1.\tI agree to make full and accurate disclosure of all written and verbal information that is relevant to the issues being mediated, including but not limited to the disclosure of financial information. I further agree to duly update our disclosed information if it materially changes during the mediation process.<br \/>\r\n \r\n9.2.\tI understand and agree that if the Mediator has reason to believe that full and accurate disclosure has not occurred, they may terminate the mediation process.\r\n<br \/>\r\n<br \/>\r\n<h3>10.\tCOST OF MEDIATION<\/h3><br \/>\r\n10.1.\tI understand that we will not be charged any fees for on-site family mediation services.<br \/>\r\n<br \/>\r\n<h3>11.\tTERMINATION OF MEDIATION<\/h3><br \/>\r\n11.1.\tI understand that each Party has the right to withdraw from the mediation process at any time with prior notice to the Mediator and every other Party or their lawyer.<br \/>\r\n\r\n11.2.\tI understand that the Mediator has the right to terminate the mediation process at any time and for any reason with prior notice to all Parties or their lawyers.\r\n<br \/>\r\n<br \/>\r\n<h3>12.\tPARTICIPANTS, INTERNS AND OBSERVERS<\/h3><br \/>\r\n12.1.\tI understand that this mediation process may include participants, interns or observers from time to time with our consent. The purpose is to allow these students an avenue for obtaining practical experience under the supervision of Mediation Centre Ontario Inc. We do however have the right to decline this mediation process.<br \/>\r\n12.2.\tI understand that the participants, interns or observers has the same duty of confidentially as the Mediator.\r\n<br \/>\r\n<br \/>\r\n<h3>13.\tUNDERTAKINGS AND ACKNOWLEDGMENTS<\/h3><br \/>\r\n13.1.\tI agree that neither one of us nor our lawyers will initiate any legal proceeding or take any further steps in an existing legal proceeding, during the mediation process. The only exceptions to this are as follows:\r\n<br \/>\r\n<div style=\"margin-left: 50px\">\t\r\n(a)\tAll Parties consent in writing prior to any action being taken; or<br \/>\r\n(b)\tThere are urgent circumstances warranting an order without notice.<br \/>\r\n<\/div><br \/>\r\n13.2.\tI agree that neither one of us nor our lawyers will, without the other Party\u2019s prior written consent, take any of the following actions during the mediation process:  <br \/>\r\n<div style=\"margin-left: 50px\">\t\r\n(a)\tAttempt to dispose of (including but not limited to destroy, sell, or transfer) or mortgage any property or asset or interest in a property or asset;<br \/>\r\n(b)\tIncur any significant debt; or <br \/>\r\n(c) Change beneficiaries of life insurance plans, death benefits, or health insurance plans.\r\n\r\n<\/div>\r\n\r\n<br \/>\r\n<h3>14.\tLIMITATIONS<\/h3><br \/>\r\n14.1.\tI understand that there is no guarantee of resolution from mediation, and that I may not be fully satisfied with the outcome.<br \/>\r\n\r\n14.2.\tThe parties hereto understand that any mediation related services (the \u201cMediation Services\u201d) being provided to the public is under an arrangement with His Majesty the King in right of Ontario as represented by the Attorney General (the \u201cMinistry\u201d). The parties hereto acknowledge that (a) the provider of the Mediation Services and its directors, officers, employees, subcontractors, and agents are not agents, joint venturers, partners, or employees of the Ministry; and (b) the Ministry does not assume any responsibility for any service, action, and inaction provided with respect to the Mediation Services. \r\n<br \/>\r\n \r\n14.3.\tIn no event shall the parties hereto, either jointly or separately, hold the Ministry liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence, or other tort, arising out of or in connection with, either directly or indirectly, the use of the Mediation Services.<br \/>\r\n\r\n\r\n\r\n<\/div><\/div><div id=\"wpforms-542-field_18-container\" class=\"wpforms-field wpforms-field-checkbox\" data-field-id=\"18\"><label class=\"wpforms-field-label wpforms-label-hide\" for=\"wpforms-542-field_18\">Agree 1 <span class=\"wpforms-required-label\">*<\/span><\/label><ul id=\"wpforms-542-field_18\" class=\"wpforms-field-required\"><li class=\"choice-1 depth-1\"><input type=\"checkbox\" id=\"wpforms-542-field_18_1\" name=\"wpforms[fields][18][]\" value=\"I acknowledge that I have read this Agreement to Mediate.
